In the course of its business, Oeni collects and processes information, some of which is referred to as "personal data". Oeni attaches great importance to respect for privacy, and only uses data in a responsible and confidential manner and for a specific purpose.

ARTICLE 1 : Data collection and protection

1.1 DATA COLLECTED

Your data is collected by the Oeni application.

Personal data means any information relating to an identified or identifiable natural person (data subject); an identifiable person is one who can be identified, directly or indirectly, in particular by reference to a name, an identification number or one or more factors specific to his or her physical, physiological, genetic, mental, economic, cultural or social identity.

The personal data collected is as follows:

  • when you register :

Your e-mail address, password, last name, first name and date of birth.

  • when using the :

Geolocation is collected with your consent and is not disclosed. The same applies to access to your camera and photo library. These authorizations enable optimal use of the application's services.

Localization will enable us to carry out studies and analyses, as well as suggest commercial offers close to you.

We gather information about your taste profile so that we can recommend wines that match your tastes.

We record the information you provide when using the application, i.e. wines added to your wines or cellar, your tasting notes and comments. We also record your browsing and communications on the "find my wine" chat.

Users are encouraged not to divulge any personal information on the application, whether in comments on a wine, in photos or in chat with our specialists. If a user does disclose such information, he or she must be able to provide a legal basis for doing so.

Here are the details of the different uses made of your data:

  • access and use of the application by the user
  • operation management and application optimization
  • implementation of user assistance
  • anonymized statistical analyses in order to improve the application and provide anonymized reports to partner chains, so that they can make decisions about their offer
  • sending notifications or commercial offers based on your preferences and interests

1.2 DATA RETENTION PERIOD :

Your data will be stored for as long as is necessary to provide you with our services and support.

To the extent reasonably necessary or required to satisfy legal or regulatory obligations, settle disputes, prevent fraud and abuse or enforce our terms and conditions, we may also retain some of your information as necessary, even after you have closed your account or we no longer need to provide our services to you.

Your account data (surname, first name, email address, date of birth, profile photo) will be kept for 3 years after your last connection to the application.

Connection data is kept for 2 years after the last connection to the application.

Where applicable, for the duration of the dispute and until all other avenues of appeal have been exhausted.

1.3 WHAT ARE YOUR RIGHTS AND HOW TO EXERCISE THEM?

Pursuant to the regulations applicable to personal data, users have the following rights:

  • right of access: you can exercise your right of access to your personal data by writing to the e-mail address below;
  • the right of rectification: if the personal data held by Vinidaily is inaccurate, you may request that this information be updated;
  • the right of deletion of data: you may request the deletion of your personal data, in accordance with applicable data protection laws;
  • the right to the limitation of processing: you can ask Oeni to limit the processing of personal data in accordance with the assumptions provided for by the RGPD ;
  • the right to object to data processing: you may object to your data being processed in accordance with the assumptions set out in the RGPD ;
  • the right to portability: you can ask Vinidaily to give you the personal data you've provided so that you can transfer it to another platform.

1.4 SHARING PERSONAL DATA WITH THIRD PARTIES :

Personal data may be shared with third-party companies exclusively within the European Union, in the following cases:

  • when the user publishes publicly accessible information in the application's free comment areas
  • when the application uses the services of service providers to provide user assistance, information on wines or wines from the places visited, advertising and payment services. These service providers have limited, anonymized access to user data in the course of providing these services, and are contractually obliged to use it in compliance with the provisions of the applicable regulations on the protection of personal data.
  • if required by law, the application may transmit data to pursue claims against Oeni and to comply with administrative and judicial proceedings.

1.5 APPLICABLE LAW :

The present conditions of use of the site are governed by French law and are subject to the jurisdiction of the courts of the publisher's registered office, subject to a specific attribution of jurisdiction arising from a particular legal or regulatory text.
